1. Acceptance of Terms

By accessing or using the RuTruckers website located at rutruckers.com (the "Site"), submitting an application through the Site, or engaging with any of our services, you ("you," "User," or "Applicant") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or submit any information through it.

2. Description of Services

RuTruckers operates a driver recruitment and logistics coordination platform that connects owner-operators with freight opportunities. Through the Site, prospective drivers may submit applications to be considered for partnership with RuTruckers. Our services include but are not limited to driver recruitment, dispatch support, freight coordination, and onboarding assistance.

3. Eligibility

To use our services and submit an application, you must:

• Be at least 21 years of age
• Hold a valid Commercial Driver's License (CDL) issued in the United States
• Be legally authorized to work in the United States
• Meet all applicable federal and state requirements for operating a commercial motor vehicle

4. Application Submission

When you submit an application through the Site, you agree to provide accurate, current, and complete information including your full name, phone number, email address, CDL type, years of driving experience, current location, and truck type. You are responsible for the accuracy of all information submitted. Providing false or misleading information may result in rejection of your application or termination of any subsequent agreement.

Submitting an application does not guarantee acceptance into the RuTruckers network. RuTruckers reserves the right to approve or deny any application at its sole discretion.

5. Communications Consent

By submitting your phone number and email address through the application form, you consent to receive communications from RuTruckers and its representatives, including phone calls, text messages (SMS), and emails related to your application, onboarding, and available freight opportunities. Message and data rates may apply. You may opt out of text messages at any time by replying STOP.

6. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Submit false, inaccurate, or misleading information
• Attempt to gain unauthorized access to any part of the Site or its systems
• Interfere with or disrupt the operation of the Site
• Use automated tools, bots, or scripts to access or interact with the Site without prior written consent

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of RuTruckers or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without prior written permission from RuTruckers.

8. Disclaimer of Warranties

The Site and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. RuTruckers does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Any earnings figures, rates, or income projections displayed on the Site are estimates only and do not constitute a guarantee of income. Actual earnings depend on various factors including but not limited to miles driven, routes assigned, market conditions, and individual performance.

9. Limitation of Liability

To the maximum extent permitted by applicable law, RuTruckers, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or services, regardless of the theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless RuTruckers, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by RuTruckers. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

12. Modifications to Terms

RuTruckers reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Termination

RuTruckers may terminate or suspend your access to the Site at any time, without prior notice or liability, for any reason, including if you breach these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Harris County, Texas.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
